Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EverMargin website and service (the "Service") provided by Chad Toronchuk ("EverMargin", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The service

EverMargin is a profitability and pricing dashboard for sellers using Etsy and print-on-demand platforms such as Printify and Printful. Features and pricing may change over time.

2. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Acceptable use

You agree not to misuse the Service, including by:

• Using it for unlawful purposes, fraud, or spam.
• Infringing intellectual property or privacy rights.
• Interfering with security, probing, scraping, or attempting to access systems without authorisation.
• Reverse engineering, reselling, or redistributing the Service.

4. Intellectual property

We retain all rights to the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan and these Terms.

5. Your content

You retain ownership of the data you upload or that we sync on your behalf. You grant us a limited licence to host and process that data solely to provide the Service.

6. Payment, subscription, and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are also governed by the Paddle Buyer Terms.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your billing page or through Paddle. See our Refund Policy.

7. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may terminate your account at any time from your settings page.

8. Service level and warranties

The Service is provided "as is". We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.

10. Indemnity

You agree to indemnify us against claims arising from your content, your use of the Service in breach of these Terms, or your violation of any law.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the seller's jurisdiction, without regard to its conflict of laws rules. Disputes will be resolved in the courts of that jurisdiction, unless local law requires otherwise.
