This Privacy Notice describes how Chad Toronchuk ("EverMargin", "we", "us") collects, uses, and shares personal data when you use the EverMargin website and service (the "Service"). We act as the data controller for the personal data described in this notice.
1. Personal data we collect
- Account data: name, email address, password (hashed), and authentication identifiers.
- Shop data: Etsy and Printify/Printful shop identifiers, products, variants, costs, and order/transaction records you import or that we sync on your behalf.
- Support communications: messages you send to us and our replies.
- Usage and device data: pages visited, features used, IP address, browser type, and similar telemetry.
- Billing data: billing data is collected and processed by Paddle (see "Data sharing" below). We receive a transaction record (amount, currency, status, timestamps) so we can manage your subscription.
2. How we use your data
- Create and operate your account and provide the Service.
- Sync, calculate, and display your shop, product, and profitability data.
- Process subscriptions, prevent fraud, and meet our legal obligations.
- Provide customer support and respond to your requests.
- Improve the Service and develop new features.
3. Legal basis
We process personal data on the basis of (a) performance of our contract with you, (b) our legitimate interests in operating and securing the Service, (c) your consent where required, and (d) compliance with legal obligations.
4. Data sharing
- Service providers / subprocessors: hosting, database, email, and analytics providers acting on our instructions.
- Merchant of Record (Paddle): Paddle.com Market Limited acts as the merchant of record for sales of EverMargin Pro and handles payment processing, billing, tax compliance, invoicing, refunds, and related customer service.
- Connected platforms: when you connect Etsy, Printify, or Printful, we exchange data with those platforms strictly to provide the Service you requested.
- Professional advisers and authorities where reasonably necessary or required by law.
5. Data retention
We retain personal data for as long as your account is active and for a reasonable period afterwards to comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, it is deleted or anonymised.
6. Your rights
Subject to your local law, you may have the right to access, correct, delete, restrict or object to processing of your personal data, and to data portability. You can exercise these rights by emailing us at the address below. You also have the right to lodge a complaint with your local data protection authority.
7. Security
We use appropriate technical and organisational measures (encryption in transit, access controls, and secure cloud infrastructure) to protect personal data. No system is perfectly secure, and we cannot guarantee absolute security.
8. Cookies
We use essential cookies required to keep you signed in and to operate the Service. We may use a small number of analytics cookies to understand how the Service is used. You can control cookies through your browser settings.
9. International transfers
Your data may be processed in countries other than your own. Where required, we use appropriate safeguards such as standard contractual clauses.
